Learning Outcomes:

At the end of the module/unit the learner will be able to:

  • Identify illegal (discriminatory) practices in recruitment
  • Include minimum legal clauses in an employment contract
  • Identify instances of workplace harassment, discrimination and victimisation
  • Identify what disciplinary actions are permitted and how to go about them to mitigate the impact of and avoid costly litigation
  • Determine how collective redundancies are deemed differently from individual redundancies
  • Identify principles emanating from the Act, such as the Equal pay for job of equal value
  • List the salient points of the Employment and Industrial Relations Act (EIRA)
  • Define what could be deemed as an unfair dismissal.
  • Distinguish termination procedures between fixed term and indefinite term employees
  • Describe family based rights that are applicable such as parental leave entitlements, urgent family leave entitlements and other family entitlements
  • Describe the different social security benefits that employees are entitled to, with particular reference to pensions
  • Describe the rights and entitlements that part-time workers have
  • Describe the different working time regulations that are relevant to different industrial sectors employees
  • Apply the provisions of a Subsidiary Legislation whenever it regulates particular Economic activity
  • Calculate pro-rata benefits for Part-time employees
  • Apply the first-in-last out principle whenever a collective redundancy takes place
  • Demonstrate what is the status of an employee who underwent a transfer of business between a transferor and a transferee
  • Distribute rosters in such a way that they adhere to the working time regulations
  • Make use of the provisions of the Collective Agreement to take disciplinary action in respect to one of the employees
